Information Relating to the Sale of Ephedrine, Pseudoephedrine, or Phenylpropanolamine Products

The 2005 Washington Legislature passed bill ESHB 2266 which added sections to RCW 69.43 restricting access to certain precursor drugs used to manufacture methamphetamine to ensure that they are only sold at retail to individuals who will use them for legitimate purposes.

The law requires the Board of Pharmacy to develop rules ( WAC 246-889, sections 070 thru 110) that will set the standards for the collection and maintenance transaction logs for the sale of ephedrine, pseudoephedrine, and phenylpropanolamine products.

A letter summarizing the requirements of the new laws and regulations was mailed to all registered shopkeepers, and itinerant vendors on December 30, 2005.

Pseudoephedrine Package Restriction Exemptions:

The following products are exempt from pseudoephedrine package restrictions contained in RCW 69.43.110 and 69.43.120:

Suggested Language for Sign 

Washington State law restricts the sale & possession of drug products containing the substances ephedrine, pseudoephedrine, or phenylpropanolamine.

It is illegal to:   
  • Sell more than 2 packages in a single transaction;
  • Purchase more than 2 packages in 24 hours;
  • Possess more than a total of 15 grams of these substances.

These restrictions do not apply to products intended for pediatric use.
