State disciplines health care providers

OLYMPIA ¾ The Health Professions Quality Assurance Office (HPQA) of the Washington State Department of Health has taken disciplinary actions or has withdrawn charges against health care providers in the state.

HPQA is responsible for protecting and enhancing the health of the people of Washington by assuring access to safe, competent health care providers. HPQA personnel work in partnership with 12 boards, four commissions, and nine advisory committees to set licensing standards for 55 health care professions (e.g., medical doctors, nurses, counselors).

Information on Washington’s health care providers is now available online at our new Provider Credential Search Web site (https://fortress.wa.gov/doh/hpqa1/Application/Credential_Search/profile.asp). The site includes information about a health care provider’s license status, the expiration and renewal date of their credential, disciplinary actions and copies of legal documents issued after July 1998. This information is also available by calling HPQA, 360-236-4700. Consumers who think a health care provider acted unprofessionally are also encouraged to call and report their complaint.

There is currently an opening on the Orthotics and Prosthetics Advisory Committee for a licensed physician specializing in orthopedic medicine or surgery or physiatry. Please contact 360-236-4947 for information.

Benton County

In October 2004 the Nursing Commission reinstated the license of Helen R. Pines to practice nursing (LP00027595, RN00080169).

Franklin County

In October 2004 the Nursing Assistant Program placed the certification of nursing assistant Randy R. Ferguson (NC10048774), on probation for five years (after he pays a renewal fee). He failed to comply with the terms and conditions of a prior order.

Island County

In October 2004 the Nursing Commission charged Leslie K. Larue, a licensed practical nurse (LP00036499), with unprofessional conduct. She allegedly failed to comply with the terms and conditions of a prior order and submitted a positive urinalysis test.

King County

In October 2004 the Pharmacy Board charged pharmacist Sandra L. Jakobson (PH00010121) with unprofessional conduct. Jakobson allegedly failed to comply with a prior order.

In October 2004 the Dental Commission charged dentist Marc R. Joondeph (DE00004629) with unprofessional conduct. Allegations against him include contacting minor patients through the Internet and engaging in inappropriate and/or sexual conversations with them, possessing child pornography and diverting a controlled substance from his workplace.

In October 2004 the Dental Commission withdrew a statement of charges against dentist David W. Larson (DE00006216).

In October 2004 the Midwifery Program charged midwife Shaheeda L. Pierce (MW00000261) with unprofessional conduct. She allegedly provided neonatal services that fell below standard.

In October 2004 the Registered Counselor Program charged Craig W. Powers, an applicant to practice as a registered counselor (CA00006828), with unprofessional conduct. He allegedly concealed several criminal convictions on his application, including possessing a dangerous weapon, driving with a suspended license and theft.

In October 2004 the Nursing Commission charged registered nurse David Simpkins (RN00142192) with unprofessional conduct. Simpkins allegedly diverted a controlled substance for his own use and submitted positive urinalysis tests.

In October 2004 the Medical Commission charged physician James A. Tremann (MD00010942) with unprofessional conduct. Allegations against him include failure to comply with the terms and conditions of a prior order.

In October 2004 the Medical Commission amended a statement of charges against physician William S. Yale (MD0014013). He is being charged with unprofessional conduct for allegations including aiding and abetting the unlicensed practice of medicine, failure to inform a patient of the risks or side effects associated with a procedure and failure to cooperate with the investigation.

Pierce County

In October 2004 the Massage Program entered a Final Order with Elaine Berry (MA00001339). Prior to reactivating her license to practice massage therapy, she must complete an exam. Her license will then be granted and placed on probation for three years. Berry must not engage in solo practice, including not practicing in private homes, and must submit performance reports. She was convicted of forgery and use of drug paraphernalia. Elaine Berry is also known as Elaine Black.

In September 2004 the Nursing Commission reinstated the license of Robert C. Boord, to practice as a licensed practical nurse (LP00036913). His license will be placed on probation for two years. He must comply with treatment and monitoring, complete payments of a fine and complete a refresher course.

In October 2004 the Nursing Commission charged registered nurse Sharon D. Chapman (RN00144051) with unprofessional conduct. Allegations against Chapman include diverting controlled substances from her workplace and being convicted of unlawfully possessing a controlled substance.

In October 2004 the Dental Commission charged dentist Richard Guzha (DE00008246) with unprofessional conduct. He allegedly provided services that were below the standard of care.

In October 2004 the Nursing Commission charged Thomas M. McDonald, a licensed practical nurse (LP00049187), with unprofessional conduct. McDonald allegedly diverted controlled substances from his workplace for his own use.

Snohomish County

In October 2004 the Nursing Assistant Program charged nursing assistant Jabou Njie (NA00110937) with unprofessional conduct. She was allegedly convicted of theft. Jabou Njie is also known as Jabou Drammeh.

In October 2004 the Nursing Commission amended a statement of charges against registered nurse Betsy A. Raap (RN00110272). She is being charged with unprofessional conduct for failing to comply with the terms and conditions of a prior order and submitting false documents to the commission.

Whitman County

In October 2004 the Unlicensed Practice Program issued a Notice of Intent to Issue a Cease and Desist Order against Amy Bay. She allegedly practiced dentistry without a license.

In October 2004 the Unlicensed Practice Program issued a Notice of Intent to Issue a Cease and Desist Order against Lisa Carter. She allegedly practiced dentistry without a license.

Yakima County

In October 2004 the Nursing Assistant Program charged Patricia M. Nkounkou, an applicant to practice as a nursing assistant (CA00038204), with unprofessional conduct. She was allegedly convicted of assault.

Out of State

(Many health care providers hold licenses in more than one state. Department of Health receives information each month from national groups on disciplined health care providers. When another state’s regulatory group takes actions, the equivalent board/commission/program in Washington files unprofessional conduct charges against the provider’s Washington credential.)

Arizona: In October 2004 the Medical Commission charged Jeffrey I. Livovich, a physician licensed in Washington (MD00027138), with unprofessional conduct based on action taken in another state. The Arizona Board took disciplinary action against his Arizona medical license.

Hawaii: In October 2004 the Pharmacy Board charged Ellen Y. Demchok, a pharmacy technician licensed in Washington (VA00016352), with unprofessional conduct. Allegations against her include failing to comply with the terms and conditions of a prior order and failing to cooperate with the disciplining authority during investigation.

Idaho: In October 2004 the Medical Commission charged David L. Schenkar, a physician licensed in Washington (MD00011364), with unprofessional conduct based on action taken in another state. In 2003 the Idaho Board of Medicine restricted him from performing surgeries in Idaho.

New York: In October 2004 the Nursing Commission charged Adrienne M. Wieland, a registered nurse licensed in Washington (RN00129368), with unprofessional conduct. She allegedly diverted controlled substances from her workplace.

North Carolina: In October 2004 the Medical Commission released Steven E. Bentley, a physician licensed in Washington (MD00026142), from an Agreed Order.

Oregon: In October 2004 the Medical Commission charged David A. Dubin, an applicant to practice as a physician in Washington (MC00014871), with unprofessional conduct based on action taken in another state. He allegedly had disciplinary action taken against his Oregon medical license.

Note to Editors: Health care providers charged with unprofessional conduct have 20 days to respond to Department of Health in writing. The case then enters the settlement process. If no disciplinary agreement can be reached, the case will go to a hearing.
