State disciplines health care providers

OLYMPIA ¾ The Health Professions Quality Assurance Office (HPQA) of the Washington State Department of Health has taken disciplinary actions or has withdrawn charges against health care providers in the state.

HPQA is responsible for protecting and enhancing the health of the people of Washington by assuring access to safe, competent health care providers. HPQA personnel work in partnership with 12 boards, four commissions, and nine advisory committees to set licensing standards for 55 health care professions (e.g., medical doctors, nurses, counselors).

Information on Washington’s health care providers is now available online at our new Provider Credential Search Web site (https://fortress.wa.gov/doh/hpqa1/Application/Credential_Search/profile.asp). The site includes information about a health care provider’s license status, the expiration and renewal date of their credential, disciplinary actions and copies of legal documents issued after July 1998. This information is also available by calling HPQA, 360-236-4700. Consumers who think a health care provider acted unprofessionally are also encouraged to call and report their complaint.

There is currently an opening on the Orthotics and Prosthetics Advisory Committee for a licensed physician specializing in orthopedic medicine or surgery or physiatry. Please contact 360-236-4947 for information.

Clallam County

In November 2004 the Registered Counselor Program charged Mark P. Hynes, an applicant to practice as a registered counselor (CA00007006), with unprofessional conduct. Hynes was allegedly convicted of assaulting a child.

Franklin County

In November 2004 the Pharmacy Board charged pharmacist James Craig Hudkins (PH00019433) with unprofessional conduct. He was allegedly convicted of nine counts of theft.

King County

In November 2004 the Dental Commission charged dentist Paul L. Alota (DE00007365) with unprofessional conduct. Allegations against Alota include billing for services not provided and providing services that fell below the standard of care.

In November 2004 the Medical Commission charged physician Mary L. Ballard (MD00025316) with unprofessional conduct. Allegations against Ballard include having a personal relationship with a patient and using her position as a physician to interfere with the patient’s care and his worker’s compensation claim.

In November 2004 the Registered Counselor Program charged registered counselor Gwendolyn S. Bauer (RC00019626) with unprofessional conduct. She allegedly failed to comply with the terms and conditions of a prior order.

In November 2004 the Massage Program charged Melanie Berry, licensed to practice massage (MA00015536), with unprofessional conduct. Berry’s license to practice as a registered counselor was allegedly suspended for three years.

In November 2004 the Medical Commission withdrew a statement of charges against physician Robin L. Downey (MD00025489).

In November 2004 the Medical Commission placed the license of physician Kevin C. Elliott on a stayed suspension for 10 years. He must comply with several terms and conditions of the Final Order. Charges against Elliott include being convicted of assault.

In November 2004 the Registered Counselor Program charged Dean G. Jacobson, applicant to practice as a registered counselor (CA00006685), with unprofessional conduct. Jacobson was allegedly convicted of unlawfully possessing a controlled substance.

In November 2004 the Medical Commission charged physician James R. Pinkham (MD00011434) with unprofessional conduct. Allegations against him include inappropriately performing carpal tunnel release surgery on a patient.

In November 2004 the Registered Counselor Program modified an Agreed Order with Joseph V. Raineri, a registered counselor (RC00032954). The time he has to pay a fine and complete continuing education has been extended.

In November 2004 the Dental Commission charged dentist Douglas A. Seymour (DE00006613) with unprofessional conduct. Allegations against him include providing treatment that fell below the standard of care and billing for services not provided.

In November 2004 the Pharmacy Board charged Landis Stovall, a pharmacy assistant (VB00056561), with unprofessional conduct. Stovall allegedly failed to comply with the terms and conditions of a prior order.

Okanogan County

In November 2004 the Health Care Assistant Program charged Joyce L. Moreno, a health care assistant (HC00135043), with unprofessional conduct. She allegedly failed to comply with the terms and conditions of a prior order.

Pierce County

In November 2004 the Nursing Commission reinstated the license of Elizabeth McFadden to practice as a licensed practical nurse (LP00041797). Elizabeth McFadden is also known as Elizabeth Young.

In November 2004 the X-Ray Technician Program charged Michael E. Roberts, an x-ray technician (XT00003015), with unprofessional conduct. He was allegedly convicted twice of assault, and his license to practice as a licensed practical nurse was restricted based on one conviction.

Snohomish County

In November 2004 the Nursing Commission charged Tracy R. Perkins, a licensed practical nurse (LP00047810), with unprofessional conduct. She allegedly failed to comply with the terms and conditions of a prior order.

In November 2004 the Nursing Commission withdrew a statement of charges against registered nurse Betsy A. Raap (RN00110272).

Spokane County

In November 2004 the Registered Counselor and Chemical Dependency Professional Programs entered a Final Order with Kathleen J. Adams (RC00022955, CP00001405). Her credentials to practice as a counselor and chemical dependency professional are expired. Prior to applying for reactivation of her credentials, she must undergo evaluations and submit a report to the programs.

In November 2004 the Licensed Mental Health Counselor Program placed the license of Majil A. Fausel, a mental health counselor (LH00006964), on a stayed suspension for five years. She must complete continuing education and pay a $5,000 fine. She must not supervise others or engage in solo practice. Fausel inappropriately crossed professional boundaries with a client and tried to convince the client to lie to investigators.

In November 2004 the Registered Counselor Program charged registered counselor James A. Lippold (RC00015144) with unprofessional conduct. Allegations against him include failing to take prompt and appropriate action after an employee, whom he supervised, crossed professional boundaries with a client.

Thurston County

In November 2004 the Registered Counselor Program charged registered counselor Jean M. Bohling (RC00040931) with unprofessional conduct. She allegedly engaged in a social relationship with a client.

Out of State/Country

(Many health care providers hold licenses in more than one state. Department of Health receives information each month from national groups on disciplined health care providers. When another state’s regulatory group takes actions, the equivalent board/commission/program in Washington files unprofessional conduct charges against the provider’s Washington credential.)

Canada: In November 2004 the Respiratory Care Practitioner Program charged Jon G. Marion, credentialed to practice as a respiratory care practitioner in Washington (LR00003361), with unprofessional conduct. Marion allegedly failed to comply with the terms and conditions of a prior order.

Idaho: In November 2004 the Nursing Commission charged John D. Bartosh, a registered nurse licensed in Washington (RN00136194), with unprofessional conduct. He allegedly failed to comply with the terms and conditions of a prior order.

Maryland: In November 2004 the Medical Commission charged Keith E. Cook, a physician licensed in Washington (MD00041926), with unprofessional conduct. In 2003 he was allegedly arrested for driving under the influence and possessing cocaine.

Minnesota: In November 2004 the Medical Commission entered an Agreed Order with Ann K. Friedmann (MD00032928). She is currently residing in and practicing medicine in Minnesota. She has no intention of practicing medicine in the state of Washington.

Mississippi: In November 2004 the Nursing Commission charged Deltona Tibbets-Figliola, a registered nurse and advanced registered nurse practitioner (RN00131844, AP30004874) licensed in Washington, with unprofessional conduct. In March 2004, her licenses to practice nursing in Indiana were suspended.

Note to Editors: Health care providers charged with unprofessional conduct have 20 days to respond to Department of Health in writing. The case then enters the settlement process. If no disciplinary agreement can be reached, the case will go to a hearing.
