State disciplines health care providers

OLYMPIA ¾ The Health Professions Quality Assurance Office (HPQA) of the Washington State Department of Health has taken disciplinary actions or has withdrawn charges against health care providers in the state. The information on the cases reported in this news release represents the status of each item on the date the news release was issued.

HPQA is responsible for protecting and enhancing the health of the people of Washington by assuring access to safe, competent health care providers. HPQA personnel work in partnership with 12 boards, four commissions, and nine advisory committees to set licensing standards for 55 health care professions (e.g., medical doctors, nurses, counselors).

Information on Washington’s health care providers is now available online at our new Provider Credential Search Web site (https://fortress.wa.gov/doh/providercredentialsearch/). The site includes information about a health care provider’s license status, the expiration and renewal date of their credential, disciplinary actions and copies of legal documents issued after July 1998. This information is also available by calling HPQA, 360-236-4700. Consumers who think a health care provider acted unprofessionally are also encouraged to call and report their complaint.

Chelan County

In July 2005 the Nursing Assistant Program denied the application of Lisa L. McBride to practice as a nursing assistant (CA00039915). She may not reapply for five years. McBride was convicted of theft.

In July 2005 the Nursing Assistant Program charged nursing assistant Lonnie I. Reese (NA00166301) with unprofessional conduct. She allegedly practiced as a nursing assistant while impaired by alcohol.

Clark County

In July 2005 the Medical Commission amended an Order against physician Huong T. Luu (MD00030582). He is allowed to treat female patients for gynecological and obstetric issues. Other terms and conditions of the previous order remain in effect.

King County

In July 2005 the Unlicensed Practice Program issued a Notice of Intent to issue a Cease and Desist Order against Jack Arnold. Arnold allegedly offered to treat and treated medical conditions among the public for a fee. He is not licensed to practice medicine in Washington.

In July 2005 the Unlicensed Practice Program issued a Notice of Intent to issue a Cease and Desist Order against Carol Cote. Cote allegedly offered to treat and treated medical conditions among the public for a fee. She is not licensed to practice medicine in Washington.

In July 2005 the Nursing Assistant Program charged nursing assistant Nema Kinz (NA00168098) with unprofessional conduct. She allegedly consumed and was impaired by alcohol and marijuana while on duty.

In July 2005 the Unlicensed Practice Program issued a Notice of Intent to issue a Cease and Desist Order against Bin "Sam" Xia. Xia allegedly performed a massage. Xia is not licensed to practice massage in Washington. Bin "Sam" Xia is also known as Xia Bin.

In July 2005 the Unlicensed Practice Program issued a Notice of Intent to issue a Cease and Desist Order against Cindy Yonck. She allegedly offered to treat and treated medical conditions among the public for a fee. Yonck is not licensed to practice medicine in Washington.

Kitsap County

In July 2005 the Surgical Technologist Program charged Ryan D. Jensen, a surgical technologist (ST00002527), with unprofessional conduct. He allegedly failed to comply with prior terms and conditions on his license.

In July 2005 the Pharmacy Board charged Maria E. McMahon, a pharmacy technician (VA00042510), with unprofessional conduct. Allegations against her include practicing while her certification was expired and altering her posted certification to show a different expiration date.

Pacific County

In July 2005 the Nursing Assistant Program denied the application of Shauna G. Phillips to practice as a nursing assistant (CA00039077). She may not reapply for five years. Phillips was convicted of many counts of theft.

Pierce County

In July 2005 the Pharmacy Board charged pharmacist Lisa L. Golden (PH00016665) with unprofessional conduct. Allegations against her include diverting controlled substances from her workplace for her own use.

In July 2005 the Nursing Commission charged Chay Lee, an applicant to practice as a registered nurse (CA00057683), with unprofessional conduct. On her application, she allegedly misrepresented that she attended an accredited college.

In July 2005 the Nursing Commission charged Gloria J. Rhoads, a licensed practical nurse (LP00028475), with unprofessional conduct. She allegedly called in prescriptions without a doctor’s authorization and purchased a controlled substance from a patient for her own non-therapeutic use.

In July 2005 the Pharmacy Board reinstated the certification of Cheryl Ann Sabutis to practice as a pharmacy technician (VA00041373). Cheryl Ann Sabutis is also known as Cheryl Ann Stump.

In July 2005 the Pharmacy Board reinstated the certification of Gina G. Stryker to practice as a pharmacy technician (VA00040955).

In July 2005 the Nursing Commission charged Narciso J. Trevino, a licensed practical nurse (LP00045435), with unprofessional conduct. Allegations against Trevino include throwing away patients’ medications and falsely documenting he administered them.

In July 2005 the Nursing Commission charged registered nurse Dana Lynn Ward (RN00116287) with unprofessional conduct. Allegations against her include diverting controlled substances from her workplace and providing services to patients while chemically impaired.

Skagit County

In July 2005 the Pharmacy Board reinstated the license of Marjorie W. Foote to practice as a pharmacist (PH00007338).

Snohomish County

In July 2005 the Nursing Assistant Program charged Ritchie H. Garcia, an applicant to practice as a nursing assistant (CA00039489), with unprofessional conduct. Garcia allegedly listed an invalid social security number on his application.

In July 2005 the Pharmacy Board reinstated the license of Russell Gemmer to practice as a pharmacist (PH00009752).

In July 2005 the Nursing Assistant Program charged Joseph R. Wolfert, an applicant to practice as a nursing assistant (CA00041460), with unprofessional conduct. He was charged with and pled guilty to theft.

Spokane County

In July 2005 the Health Care Assistant Program modified an Agreed Order with Catherine D. Castor, a health care assistant (HC00128663). Her certification remains on a stayed suspension for one year. She must comply with terms and conditions, including paying a $1,000 fine.

In July 2005 the Registered Counselor Program amended a statement of charges against registered counselor Marc D. Deavenport (RC00049871). He is being charged with unprofessional conduct for allegedly failing to comply with the terms and conditions of a prior order.

In July 2005 the Registered Counselor Program charged Rochelle E. Helms, a registered counselor (RC00035749), with unprofessional conduct. Allegations against Helms include having a personal relationship with a client.

In July 2005 the Registered Counselor Program granted the application of Pamela F. Spotted Elk-Simms to practice as a registered counselor (CA00006682). She must comply with terms and conditions, including paying a $900 fine. She was convicted of robbery and possessing a controlled substance.

Thurston County

In July 2005 the Nursing Commission charged Joshua N. Roberts, a registered nurse technician (NS00150065), with unprofessional conduct. He allegedly failed to comply with prior terms and conditions against his license.

Whatcom County

In July 2005 the Registered Counselor Program denied the application of Haylie Christante to practice as a registered counselor (CA00006753). She was convicted of custodial interference.

Yakima County

In July 2005 the Nursing Assistant Program denied the application of Maria N. Chavez to practice as a nursing assistant (CA00040338). She may not reapply for three years. Chavez was convicted of shoplifting.

Out of State

(Many health care providers hold licenses in more than one state. Department of Health receives information each month from national groups on disciplined health care providers. When another state’s regulatory group takes actions, the equivalent board/commission/program in Washington files unprofessional conduct charges against the provider’s Washington credential.)

Oregon: In July 2005 the Medical Commission released Charles E. Chambers, an applicant to practice as a physician in Washington (MC00011883), from an Agreed Order. Chambers was released from a Minnesota Agreed Order after he complied with the terms and conditions.

Montana: In July 2005 the Chemical Dependency Professional Program and the Registered Counselor Program modified an Agreed Order with William J. Lind, a chemical dependency professional and a registered counselor licensed in Washington (CP00000809, RC0031410). Lind agrees to be supervised for three years and comply with other terms and conditions.

North Dakota: In July 2005 the Nursing Commission charged Petra Shute, a registered nurse licensed in Washington (RN00139752), with unprofessional conduct. She allegedly diverted a controlled substance from her workplace and her North Dakota license was suspended in 2004.

Note to Editors: Health care providers charged with unprofessional conduct have 20 days to respond to Department of Health in writing. The case then enters the settlement process. If no disciplinary agreement can be reached, the case will go to a hearing.
