State disciplines health care providers

OLYMPIA - The Washington State Department of Health has taken disciplinary actions or withdrawn charges against health care providers in our state.

The department’s Health Systems Quality Assurance Office works with boards, commissions, and advisory committees to set licensing standards for more than 70 health care professions (e.g., medical doctors, nurses, counselors).

Information about health care providers is on the agency Web site. Click on “Provider Credential Search” on the left hand side of the Department of Health home page (www.doh.wa.gov). The site includes information about a health care provider’s license status, the expiration and renewal date of their credential, disciplinary actions and copies of legal documents issued after July 1998. This information is also available by calling 360-236-4700. Consumers who think a health care provider acted unprofessionally are also encouraged to call and report their complaint.

Benton County

In October 2009 the Registered Counselor Program charged Laverne J. Jones (RC00044067) with unprofessional conduct. He allegedly had a personal relationship with a client, sent nude photographs to the client, and was convicted of assault.

Clark County

In October 2009 the Board of Pharmacy charged pharmacy assistant Kenneth C. Fahey (VB00071055) with unprofessional conduct. He allegedly diverted controlled substances from his place of employment, and was convicted of delivery of a controlled substance.

In October 2009 the Nursing Assistant Program charged Danesa A. Knox (NA00162775) with unprofessional conduct. She allegedly took vicodin without permission or prescription from her place of employment for her own use.

King County

In October 2009 the Nursing Commission charged licensed practical nurse Miriam V. Bernales (LP00048674) with unprofessional conduct. She owned and operated an adult family home and allegedly failed to notify a patient’s physician when a resident had skin breakdowns. Bernales was also convicted of attempted theft.

In October 2009 the Nursing Commission charged licensed practical nurse Sheila C. Cruse (LP00032550) with unprofessional conduct. She allegedly failed to administer or document administration of oxycodone, and failed to document wastage of oxycodone on multiple occasions.

In September 2009 the Medical Commission charged physician Peter Brandon (MD00029025) with unprofessional conduct. He allegedly provided substandard care while treating patients resulting in patient harm.

In October 2009 the Examining Board of Psychology charged Bruce J. Leksa (PY00001102) with unprofessional conduct. He allegedly failed to comply with conditions against his license.

In October 2009 the Massage Therapy Program reinstated the license of Yong Rip Mason (MA00000713). She is also known as Yong Rip Ludeman and Yong Rip Smith.

In October 2009 the Nursing Assistant Program charged Joanne I. Sims (NA00164970) with unprofessional conduct. She allegedly diverted a legend drug for her own use.

In October 2009 the Dental Commission charged dentist Andre George Tolas (DE00003305, GA10000117), who has a general anesthesia permit, with unprofessional conduct. He allegedly had deficiencies found when an investigator did an infection control inspection and found he practiced below the standard of care while extracting a patient’s molars.

Kitsap County

In October 2009 the Nursing Commission charged licensed practical nurse Shaundell L. Wascher (LP00057794) with unprofessional conduct. She allegedly failed to comply with terms and conditions set against her license.

Pierce County

In October 2009 the Registered Counselor Program granted the application of Steven H. Fischer (RC60085372) and placed his registration on probation for five years. He was convicted of reckless driving, and assault. He must comply with terms and conditions against his registration.

In October 2009 the X-Ray Technician Program terminated the order of probation against Michael E. Roberts (XT00003015).

In October 2009 the Nursing Assistant Program charged Crystal L. Schwab (NA00146460) with unprofessional conduct. She allegedly obtained a controlled substance by falsifying prescriptions.

Skagit County

In October 2009 physician Wirt A. Hines, III (MD00045767) was charged with unprofessional conduct. He was convicted of criminal attempt of sexual assault on a child.

In October 2009 the Medical Commission charged physician Marcus E. Kuypers (MD00019561) with unprofessional conduct. He allegedly directed a patient to be transported back to her place of residence after she had already been sent by ambulance to the emergency room for stomach pains. He then allegedly examined her and sent her back to the emergency room for a small bowel obstruction.

Snohomish County

In October 2009 the Nursing Assistant Program charged Sunita D. Chand (NA00150097) with unprofessional conduct. She allegedly submitted a job application that contained falsified certificates. She allegedly failed to respond to department inquiries about the documents.

In September 2009 the Registered Counselor and Chemical Dependency Professional Programs placed the registration and license of Douglas W. Doll (RC00027398, CP00000386) on probation for three years. He entered into a sexual relationship with the mother of one of his patients. He must comply with terms and conditions set against his registration and license.

Thurston County

In October 2009 the Nursing Assistant Program charged certified nursing assistant Gina R. Grocott (NC10093641) with unprofessional conduct. She allegedly administered less insulin than prescribed to a patient on more than one occasion.

In October 2009 the Nursing Assistant Program charged certified nursing assistant Jerome C. Martin (NC10017603) with unprofessional conduct. He was arrested for malicious mischief —domestic violence, and entered a diversion program.

In October 2009 the Registered Counselor Program granted the application of Elizabeth Ann Rice (RC60101856) and placed her registration on probation for one year. She was convicted of theft. She must comply with terms and conditions set against her registration.

Whatcom County

In October 2009 the Nursing Commission charged registered nurse Brian A. Hahnel (RN00142076) with unprofessional conduct. He allegedly failed to comply with previous terms and conditions set against his license.

Yakima County

In October 2009 the Nursing Assistant Program charged certified nursing assistant Kathy J. Case (NC10060442) with unprofessional conduct. She allegedly took $40 from a patient for her own use.

In October 2009 the Nursing Assistant Program charged certified nursing assistant Joan M. Lakey (NC10036163) with unprofessional conduct. She allegedly engaged in a verbal and physical altercation resulting in substantial bruising of a patient.

In October 2009 the Medical Commission charged physician Tekchand Tanwani (MD00035377) with unprofessional conduct. He allegedly failed to confirm the patient was the correct patient before performing surgery, and failed to personally mark the surgery site on the patient. This allegedly resulted in the surgery being performed on the wrong patient.

Out of State

Arizona: In October 2009 the Board of Physical Therapy denied the application of physical therapist assistant Frances Anne Wright (P160069088). She was convicted of theft on more than one occasion, forgery, and obtaining a benefit by means of scheme or artifice to defraud.

Idaho: In October 2009 the Nursing Assistant Program charged certified nursing assistant Christina L. Campbell (NC10099798) with unprofessional conduct. She allegedly failed to comply with terms and conditions set against her license.

Idaho: In October 2009 the Nursing Assistant Program granted the applications of certified nursing assistant Andrew Philip MacArthur (NA60080200, NC60098466) and placed conditions against his registration and certification. He was convicted of making a false or misleading statement to a public servant, reckless endangerment, and driving under the influence on more than one occasion. He must comply with terms and conditions set against his registration and certification.

Texas: In October 2009 the Board of Osteopathic Medicine charged osteopathic physician David A. Wooten, Jr. (OP00001802) with unprofessional conduct. He allegedly failed to comply with terms and conditions set against his license

Health care providers charged with unprofessional conduct have 20 days to respond to the Department of Health in writing. The case then enters the settlement process. If no disciplinary agreement can be reached, the case will go to a hearing.
