Welcome!
Welcome to the
Department of Health Rules Home Page. This website provides
information about the rules administered by the Department of
Health.
Governor Gregoire has directed
agencies under her jurisdiction to continue to suspend non-critical rule
development and adoption activities until the end of 2012. Her goal
is to help support the economy by giving small businesses and local
governments more time to devote their full attention to creating
jobs and helping communities.
Under the order, agency directors can allow
exemptions from the suspension so some specific rules may move
ahead. If a rule is not exempt, all activity, including workgroups
and stakeholder meetings, must remain on hold. Here
is a link to a document titled
DOH Rule-making Activity Under Executive Order 11-03
which lists the rulemaking which will be suspended and which will
continue. Exemptions for rules under the authority of the
State Board of Health are included in the document titled
DOH Rule-making
activity under Executive Order 11-03 and on the State Board of
Health website.
Under the guidelines from
the Office of Financial Management (OFM), rulemaking may proceed if
the rule is:

Required by
federal or state law or required to maintain federally delegated
or authorized programs;
-
Required by
court order;
-
Necessary to
manage budget shortfalls, maintain fund solvency or for revenue
generating activities;
-
Necessary to
protect public health, safety, and welfare, or necessary to
avoid an immediate threat to the state’s natural resources;
-
Beneficial to or
requested or supported by the regulated entities, local
governments or small businesses that it affects;
-
Negotiated or pilot rule making
that involves substantial participation of interested parties
(negotiated or pilot rule making that must comply
RCW 34.05.310);
-
Permanent rule making that has
previously been covered by emergency rules;
-
Expedited rule under RCW
34.05.353; or
-
Necessary to respond current
economic conditions or assist in long-term economic recovery, to
include employment assistance, consumer protection or government
reform.

The executive order
does not suspend any of our licensing, investigations, or technical
assistance. Department of Health (DOH) will
continue to do the activities, including rulemaking, that are
necessary to protect and improve the public’s health.

The Department of Health rules are administered
under Title 246 of the Washington Administrative Code (WAC).
Statutory authority is given to the Department by the Washington
State Legislature through the Revised Code of Washington (RCW).
