Rule Drafting and Revising Process

The rule drafting process is comprised of two basic steps:

Step 1 - Proposals

Once an announcement is made that there will be a rule revision, the department will distribute the current rule, highlight sections of the rule identified for possible change and open a proposal period. The department may also announce the development of new rules and distribute a set of draft rules. A proposal may be made by anyone. The department strongly encourages proposals be in writing (public proposal form) and include justification and contact information.

The department will carefully review all proposals that have been received during the designated proposal period. A "Report on Proposals" (ROP) is created, listing all proposals made interested parties along with department responses. The department will also update the draft rules, incorporating the various proposal options.  If necessary, a public meeting will be scheduled to discuss rule proposal issues.

Step 2 - Comments

Once the Report on Proposals (ROP) and updated draft rules are made available, there will be a comment period during which the public may submit written comments on the proposal options.  Comments may be made by anyone, must be in writing (public comment form), and include justification and contact information. The department will carefully review all comments that have been received during the designated comment period. If necessary, the department will schedule a public meeting to discuss rule comment issues.

All comments on proposals will then be compiled into a second publication called the Report on Comments (ROC), which will also be made available on this web site for review.

The purpose of the Report on Proposals and Report on Comments is to document the public’s recommendations to the department for changes to an existing or new rule.  The department will compile and consider all recommendations in the ROP and ROC and draft the proposed rule.
