Approved by: ______________ Purpose: This
policy is established to address the Drug-Free Workplace Act of 1988.
The purpose of this policy is to notify employees of prohibited
workplace substance abuse and to implement a program to educate Health
Department employees regarding substance abuse. Philosophy: This
policy is intended to insure that Health Department employees and the
clients it serves be free of safety hazards and reduced worker efficiency
resulting from use of controlled substances or intoxicants such as alcoholic
beverages. Policy/Procedures: It
is the policy of the Health Department to maintain a drug-free workplace.
Unlawful manufacture, distribution, dispensation, possession or use
of intoxicants, illegal drugs or controlled substances are prohibited in the
workplace. Prohibited conduct
includes, but is not limited to the following: 1. Reporting to work under the influence of intoxicants, drugs, or
controlled substances. 2. The unlawful use, possession, transfer or trafficking of intoxicants,
illegal drugs, or controlled substances in any amount or any manner on
Health Department premises, when performing Health Department duties, or in
Health Department vehicles at any time, whether or not performing Department
business anywhere, including off Health Department property. 3.
The use in any way of Health Department property or the employee's
position with the Department to make or traffic intoxicants, illegal drugs,
or controlled substances. This
policy further stipulates that: 1.
Any employee convicted for a violation of any federal or state
criminal drug statute occurring in the workplace must notify his/her
supervisor or the Human Resources Coordinator within five (5) days of the
conviction. 2. Any employee who violates any aspect of this policy may be required
to successfully complete any approved substance abuse rehabilitation program
and shall be subject to disciplinary action, up to and including dismissal. 3.
This policy does not apply to employees taking prescription drugs and
narcotics as directed by a physician or dentist provided such use shall not
endanger the employee or others. It
is the employee's responsibility to check with his/her physician, dentist or
pharmacist as to whether or not a prescription or over-the-counter drug will
impair performance and to notify his/her supervisor of the impairment and
the period of time the medication will be used.
The supervisor, in consultation with the Health Officer, will
determine whether the employee can remain at work and whether any work
restrictions will be necessary. The
Health Department shall establish an educational drug-free awareness program
to educate employees regarding substance abuse.
Such program shall include: 1.
Dangers of workplace substance abuse; 2. Information concerning available drug counseling or rehabilitative
counseling alternatives; 3. Penalties for drug abuse violations. Employees
with substance abuse problems are encouraged to seek assistance from their
supervisor, Division Director, or the Human Resources Coordinator. All
employees shall be notified of this policy.
This policy shall be distributed to all new employees during
orientation. |
