Purpose:

The purpose of this policy is to document guidelines for granting nonpaid leave.

Philosophy:

The Health Department recognizes that there are various situations that generate requests for nonpaid leave.  The Department's primary responsibility is to provide public health services in accordance with our mission statement for the residents of this County.  Provided that adequate staffing can be maintained to carry out this responsibility, and that the granting of the leave is believed to be in the long-term interest of the Health Department, nonpaid leave requests may be considered by the Executive Leadership Team.

Definitions:

Short-term Nonpaid Leave is a nonpaid leave of less than sixty (60) days and may be authorized by Division Directors, provided that adequate staff coverage can be maintained.

Long-term Nonpaid Leave is a nonpaid leave from sixty (60) days to one (1) year in duration.  Long-term nonpaid leave will be considered according to the following policy/procedures for a variety of situations which include but are not limited to extensions to family medical leave, education leave, community service and personal growth opportunities.

All nonpaid leaves are calculated in calendar, rather than work, days.

Exceptions:

Some labor agreements may include alternative definitions and provisions.  These agreements will supercede this policy when there is lack of congruence. 

Employees who enter active duty or training in the Washington National Guard, the Armed Forces of the United States, the United States Public Health Service or the Peace Corps shall be re-employed under the conditions prescribed in RCW 73.16.033.

If the Executive Leadership Team determines requests outside of this policy are appropriate, approval will be required from the Board of Health.

Policy/Procedures:

Employees requesting short-term nonpaid leave must have exhausted all applicable paid leave prior to requesting nonpaid leave.  Employees requesting long-term nonpaid leave may not be required to exhaust their leave balances.

Employees have the option to self-pay benefits while on nonpaid leave in accordance with policies determined by the benefits administrator and/or insurance carriers.

In order to be eligible for a long-term nonpaid leave, an employee must have been employed by the Department for a minimum of five (5) years.  Part-time employees must have been employed for five (5) years full-time equivalency.

Provided that the employee's supervisor finds that the long-term nonpaid leave is feasible in accordance with this policy, the Division Director will bring the request forward for consideration by the Executive Leadership Team (ELT).  If approved, the ELT will provide written notice of approval documenting the terms and conditions of such leave.  In the event that a nonpaid leave is not approved, the reasons for this decision will also be documented in writing.
