State disciplines health care providers
OLYMPIA ¾ The Health Professions Quality Assurance Office (HPQA) of the Washington State Department of Health has taken disciplinary actions or has withdrawn charges against health care providers in the state.
HPQA is responsible for protecting and enhancing the health of the people of
Washington State by assuring access to safe, competent health care providers.
HPQA personnel work in partnership with 12 boards, four commissions, and nine
advisory committees to set licensing standards for 55 health care professions
(e.g., medical doctors, nurses, counselors).
Information on Washington’s health care providers is now available online at our new Provider Credential Search Web site (https://fortress.wa.gov/doh/providercredentialsearch/). The site includes information about a health care provider’s license status, the expiration and renewal date of their credential, disciplinary actions and copies of legal documents issued after July 1998. This information is also available by calling HPQA, 360-236-4700. Consumers who think a health care provider acted unprofessionally are also encouraged to call and report their complaint.
There is currently an opening on the Orthotics and Prosthetics Advisory Committee for a licensed physician specializing in orthopedic medicine or surgery or physiatry. Please contact 360-236-4947 for information.
Benton County
In August 2004 the Nursing Commission amended a statement of charges against
Valerie A. Seabury, a licensed practical nurse and registered nurse
(LP00029681, RN00080263). She is being charged with unprofessional conduct for
allegedly failing to comply with the terms and conditions of a prior order and
testing positive for controlled substances.
Chelan County
In July 2004 the Chiropractic Commission charged chiropractor David Wall
(CH00002771) with unprofessional conduct. Allegations against Wall include
failing to make and/or keep adequate documentation of patients’ treatment and
taking substandard x-rays.
Clallam County
In July 2004 the Dental Commission withdrew a statement of charges against
dentist E. Richard Zbaraschuk (DE00006446).
Clark County
In August 2004 the Nursing Assistant Program charged nursing assistant Wayne
E. Dunn (NC10073793) with unprofessional conduct. Allegations against Dunn
include pleading guilty to obstructing a law officer and being charged of
possessing controlled substances.
In July 2004 the Dental Commission charged dentist Thomas M. Kreger (DE00005279) with unprofessional conduct. In August 2003 the Oregon Board of Dentistry allegedly entered into a Consent Order with Kreger for lying on his application, abusing drugs and prescribing drugs outside the scope of dentistry.
In July 2004 the Dental Commission charged dentist Steven J. Sorensen (DE00004256) with unprofessional conduct. Sorensen allegedly failed to comply with the terms and conditions of a prior order.
In August 2004 the Naturopathy Program charged David G. Young, an applicant for a license to practice as a doctor of naturopathic medicine (CA00000863), with unprofessional conduct. In 2003 the Oregon Board of Naturopathic Examiners allegedly issued a Consent Order against Young.
King County
In July 2004 the Dental Commission charged dentist Peter M. Cha
(DE00006848) with unprofessional conduct. Allegations against Cha include aiding
and abetting unlicensed practice by an assistant in his office and having
deficiencies during an infection control inspection at his workplace.
In August 2004 the Surgical Technologist Program granted the application of Michael A. Cyra to practice as a surgical technologist (CA00002271). He must comply with terms and conditions of the order. Cyra was allegedly convicted of harassment, possessing a controlled substance and theft.
In August 2004 the Nursing Commission charged Lora L. Harvey, a licensed practical nurse (LP00017842), with unprofessional conduct. Harvey allegedly forged prescriptions for herself and used the controlled substances for non-therapeutic use.
In July 2004 the Dental Commission charged dentist Duane L. Jones (DE00006522) with unprofessional conduct. Jones allegedly failed to cooperate with an investigation.
In August 2004 the Dental Commission amended a statement of charges against dentist Sofia D. Petrov-Myaskovsky (DE00008728). She is being charged with unprofessional conduct for allegedly providing treatment that failed to meet the standard of care.
In July 2004 the Dental Commission entered into an Agreed Order with dentist Thomas S. Safley (DE00005482). Safley agrees to complete continuing education, pay a $7,500 fine and refund fees to a patient. He provided treatment that failed to meet the standard of care.
In August 2004 the Nursing Commission charged Daniel A. Spiewak, a licensed practical nurse (LP00030392), with unprofessional conduct. Allegations against him include using a controlled substance for non-therapeutic use and testing positive in drug tests.
Kitsap County
In July 2004 the Chiropractic Commission charged chiropractor Alan Weiss
(CH00003286) with unprofessional conduct. He allegedly used the wrong billing
codes in a patient’s records.
Pierce County
In July 2004 the Counselor Programs charged Bonnie J. Malone Chandler,
an applicant to practice as a registered counselor (CA00006746), with
unprofessional conduct. She was allegedly convicted of unlawfully possessing a
controlled substance.
In August 2004 the Counselor Programs granted the application of Larry H. Hendricks to practice as a registered counselor (CA00006468). He may not engage in solo practice for three years, must pay a $1,000 fine and must have his employer submit quarterly reports. Hendricks was convicted of attempted unlawful possession of a controlled substance.
In July 2004 the Nursing Commission reinstated the license of Gina M. Weathers to practice nursing in Washington (LP0040977).
Skagit County
In August 2004 the Nursing Commission charged David T. Seamon, a
licensed practical nurse and registered nurse (LP00048624, RN00134449), with
unprofessional conduct. Seamon allegedly failed to comply with the terms and
conditions of a prior order.
Spokane County
In August 2004 the Counselor Programs charged James E. Barrett, a
mental health counselor and a chemical dependency practitioner (LH00006789,
CP00003142), with unprofessional conduct. Allegations against him include
engaging in a dual relationship with clients and failing to maintain
professional boundaries with a client.
In July 2004 the Dental Commission charged dentist Armand V. Defelice (DE00002911) with unprofessional conduct. Defelice allegedly failed to comply with the terms and conditions of a prior order.
In August 2004 the Nursing Assistant Program reinstated the registration of James F. Marsden to practice as a nursing assistant (NC10076200).
In July 2004 the Chiropractic Commission placed the license of chiropractor Shawn D. Sweeney (CH00002262) on probation for five years. He must comply with terms and conditions. His license had been revoked for criminal convictions. One of the convictions was dismissed.
Stevens County
In July 2004 the Medical Commission charged physician William Frank
Catelli (MD00017690) with unprofessional conduct. He allegedly wrote
prescriptions for a controlled substance to obtain them for his personal use.
Out of State
(Many health care providers hold licenses in more than one state. Department
of Health receives information each month from national groups on disciplined
health care providers. When another state’s regulatory group takes actions, the
equivalent board/commission/program in Washington files unprofessional conduct
charges against the provider’s Washington credential.)
Virginia: In July 2004 the Dental Commission withdrew a statement of charges against Michael K. Gazori, a dentist licensed in Washington (DE00006361).
Note to Editors: Health care providers charged with unprofessional conduct have 20 days to respond to Department of Health in writing. The case then enters the settlement process. If no disciplinary agreement can be reached, the case will go to a hearing.
